These Terms of Use (the “Terms”) govern your access to and use of the Questy Academy website (questyacademy.com), online platform, course purchasing system, account registration, and related online tutoring services (collectively, the “Service” or “Services”).

Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Interpretation and Definitions

Interpretation

The words with initial capital letters have meanings defined under the following conditions. These definitions have the same meaning whether they appear in singular or plural form.

Definitions

For the purposes of these Terms:

  • You or Your means the individual accessing or using the Service, or the parent or legal guardian registering on behalf of a student.

  • Company, We, Us, or Our refers to Questy Academy, Inc., located in Kirkland, Washington, United States.

  • Service refers to the website (questyacademy.com), online platform, course purchasing, account registration/login, and online tutoring services we provide.

  • Student means a child who participates in our tutoring sessions.

  • Account means the unique account created for You to access the Service.

  • Third-Party Conferencing Software means external video tools (e.g., Zoom or similar) used to deliver live tutoring sessions.

  • Content means all text, images, videos, course materials, and other materials provided through the Service.

Eligibility and Children’s Use

Our Service is designed for students in grades K-9. Only parents or legal guardians may register Accounts and provide information about Students.

By creating an Account or using the Service, you represent and warrant that:

  • You are at least 18 years old.

  • You are the parent or legal guardian of any Student using the Service.

  • You have the legal authority to agree to these Terms on behalf of yourself and the Student.

We do not knowingly allow individuals under 18 to register or use the Service without parental/guardian supervision.

Account Registration

To use most features of the Service, you must create an Account using your email, phone number, and name. You agree to:

  • Provide accurate, current, and complete information.

  • Keep your Account information updated.

  • Maintain the security of your password and not share your Account.

  • Notify Us immediately of any unauthorized use.

We reserve the right to refuse or terminate Accounts at our discretion.

Our Services

We provide online tutoring courses for grades 1-9. You may browse, purchase, and enroll in courses directly on the website. Live tutoring sessions are delivered through Third-Party Conferencing Software (not controlled by Us). We do not guarantee any specific academic results, grade improvements, or outcomes.

Purchases and Payments

  • All course prices are shown in U.S. dollars and include applicable taxes.

  • Payments are processed by secure third-party payment providers (We do not store full credit card information).

  • Purchases are final unless otherwise stated in our separate Refund Policy (available on the Site).

  • You agree to pay all charges associated with your Account.

  • We may change prices at any time with notice on the Site.

User Responsibilities and Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:

  • Share Account credentials.

  • Use the Service for any commercial purpose without permission.

  • Upload or transmit harmful code, viruses, or illegal content.

  • Harass, abuse, or threaten other users or tutors.

  • Record sessions without explicit written consent from all participants.

  • Allow anyone other than the registered Student to attend paid sessions.

Parents/guardians are fully responsible for supervising Students during sessions and ensuring appropriate behavior and environment.

Intellectual Property

All Content, course materials, logos, and software on the Service are owned by Us or our licensors and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Content solely for your personal, non-commercial educational purposes during your enrollment. You may not copy, modify, distribute, or create derivative works without Our prior written consent.

Termination

We may suspend or terminate your Account or access to the Service at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (such as disclaimers, limitations of liability, and governing law) will continue to apply.

Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, error-free, or that tutoring will achieve any specific results.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total liability shall not exceed the amount you paid to Us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold Us harmless from any claims, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service.

  • Any breach of these Terms.

  • Any actions of your Student.

Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in King County, Washington.

Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top indicates the latest revision. Your continued use of the Service after changes constitutes acceptance of the new Terms.
